If the User chooses to open the website, search and access information, register an account on the website, purchase through the web shop, or use the features of the website in any other way, the User will be agreeing to abide by all of the Terms and Conditions, which are subject to change from time to time.
-If rights have been violated, relating to the usage of User’s personal data, User may seek legal action. Furthermore, if there is risk of direct violation of rights, the user may request action from the National Authority for Data Protection and Freedom of Information.
User can purchase musicandjoy.com’s sheet music in printed form from the web shop. The contract of sale pertaining to each purchase does not classify as a written contract, and musicandjoy.com does not store them nor can they be accessed.
The process of purchasing
-Adding items to cart
Similar to a real store, User must place desired items in a (in this case virtual) cart before placing an order.
To do this, User may find the desired items in multiple ways with the search bar function:
If the User would like to see further information about the item, clicking on the name or the photo of the item will open a detailed description of the item. User can find the “place item in cart” button on this page as well. After the User has chosen the desired form of delivery and has confirmed the order, the User will receive a confirmation email, in which the ordered items, form of delivery, and their prices can be viewed.
The purchase and delivery of items
After the payment is received, musicandjoy.com will ship the purchased items within two business days (up to 20 days in total). The delivery fee in Hungary is 2600 HUF, and Foxpost’s delivery fee is 1690 HUF.
In cases of shipping abroad, delivery fees may vary. In these instances, our colleagues will contact the User to discuss the exact cost of delivery, within 24 hours of submitting the order.
Invoice, electronic invoice, receipt
Musicandjoy.com will produce an electronic invoice of the user’s purchase.
The User will receive the electronic invoice by email, through szamlazz.hu’s system within 24 hours of processing the order.
Musicandjoy.com releases this invoice in PDF format, with the electronic signature and timestamp approved by the Hungarian office of Tax Administration. The electronic invoice is only eligible for electronical tax administration identification. The User, as a taxpayer, is responsible for saving and archiving said electronic invoice.
According to the copyright law modified in 2004, it is forbidden by law to create copies of a product that is protected by copyright, even for personal use. Therefore, photo copying, scanning, photographing, or creating more copies with other forms of reprography of the sheet music or games is prohibited.
Musicandjoy.com pays great attention, so that all items seen in the web shop – the sheet music, gift items, musical games and their information, availability, and price is always up to date. If however the sheet music or playing cards contain a printing error that renders them unusable, musicandjoy.com will repossess them and refund the price.
The user who is considered to be a consumer as per the Act CLV of 1997 on consumer protection in the Civil Code of Hungary, has the right to cancel a purchase. As per the 17/1999 (II.5.) Government Decree on Distant Contracts (in the following, referred to as: Government Decree), when buying printed sheet music, the buyer is entitled to the right of canceling the purchase. The user has the right to cancel a purchase eight days after receiving the item, or 8 days from the time of receiving the confirmation contract, but can also exercise their right within three months of purchasing, by sending back the item purchased from MusicandJoy. The User must cover the cost of mailing back the item, but no additional fee will be charged.
The right to cancel a purchase specified by the Government Decree does not extend to users who purchased printed sheet music, or card games, but are not considered to be consumers. The user who is not considered to be a consumer has the right to withdraw and terminate the contract after placing an order, but this must proceed delivery by at least 24 hours, and can only be applied if the user contacted MusicandJoy’s customer service in a timely manner by email of telephone. In this instance, the user shall bear no costs.
The current T&C has been drafted in English and Hungarian, so the contract of sale will be created in the language the User prefers.
The current T&C and any contracts of sale relating to purchased items in reference to the current T&C have been made and will be construed and enforced in accordance with the laws of Hungary. In the case of any claim or cause of action, the Hungarian laws are authoritative.
